Account Registration & Responsibilities

To use AutoWorkx, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.
Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms, fraudulent activity, or any other reason we deem necessary to protect our platform and users.
User Responsibilities
You agree to use AutoWorkx only for lawful purposes and in accordance with these terms. You will not use the platform to send spam, malicious content, or engage in any activity that violates applicable laws or regulations.
Subscription & Payment Terms
Subscription Plans
AutoWorkx offers various subscription plans with different features and pricing. You can view current plans and pricing on our pricing page. All prices are subject to change with 30 days notice.
Billing & Payment
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. You authorize us to charge your payment method for all fees incurred under your account.
Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.
Refund Policy
We offer a 14-day money-back guarantee for new subscriptions. Refund requests must be submitted within 14 days of your initial purchase. Refunds are not available for subscription renewals or add-on purchases.
Failed Payments
If a payment fails, we will attempt to charge your payment method again. If payment continues to fail, your account may be suspended or downgraded until payment is received.
Acceptable Use Policy
Permitted Use
You may use AutoWorkx for legitimate email marketing, sales outreach, customer engagement, and business communication purposes in compliance with all applicable laws and regulations.
Prohibited Activities
You may not use AutoWorkx to: (a) send spam or unsolicited emails, (b) distribute malware or malicious content, (c) violate any laws or regulations, (d) infringe on intellectual property rights, (e) harass or harm others, (f) impersonate any person or entity, or (g) interfere with the platform's operation.
Email Compliance
You must comply with all applicable email marketing laws, including CAN-SPAM Act, GDPR, CASL, and other regional regulations. You are responsible for obtaining proper consent before sending emails to recipients.
Content Standards
All content you create or distribute through AutoWorkx must be accurate, lawful, and not misleading. You may not use the platform to promote illegal activities, hate speech, or discriminatory content.
Intellectual Property Rights
Platform Ownership
AutoWorkx and all related trademarks, logos, and service marks are owned by us. The platform's design, features, and functionality are protected by copyright, trademark, and other intellectual property laws.
Your Content
You retain all rights to the content you create and upload to AutoWorkx, including campaigns, emails, and lead data. By using our platform, you grant us a limited license to use your content solely to provide our services.
License to Use Platform
We grant you a limited, non-exclusive, non-transferable license to access and use AutoWorkx for your business purposes in accordance with these terms.
Restrictions
You may not copy, modify, distribute, sell, or lease any part of our platform or reverse engineer or attempt to extract the source code of our software.
Limitation of Liability
Service Availability
We strive to provide reliable service but do not guarantee that AutoWorkx will be available at all times without interruption. We are not liable for any downtime, service interruptions, or data loss.
Disclaimer of Warranties
AutoWorkx is provided 'as is' and 'as available' without warranties of any kind, either express or implied. We do not warrant that the platform will meet your requirements or that it will be error-free.
Limitation of Damages
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
Maximum Liability
Our total liability to you for any claims arising from your use of AutoWorkx shall not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless AutoWorkx, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, violation of these terms, or infringement of any third-party rights.
Scope of Indemnification
This indemnification obligation includes but is not limited to claims related to spam complaints, copyright infringement, data breaches caused by your actions, and violations of email marketing laws.
Data & Privacy
Data Processing
We process your data in accordance with our Privacy Policy. By using AutoWorkx, you consent to such processing and warrant that all data you provide is accurate and lawful.
Data Ownership
You retain ownership of all data you upload to AutoWorkx, including lead information and campaign content. We do not claim ownership of your data.
Data Security
We implement industry-standard security measures to protect your data. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
Data Retention
We retain your data for as long as your account is active. Upon account deletion, we will delete your data within 90 days, except where retention is required by law.
Dispute Resolution
Governing Law
These terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Arbitration
Any disputes arising from these terms or your use of AutoWorkx shall be resolved through binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act.
Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions or class arbitrations.
Informal Resolution
Before initiating arbitration, you agree to first contact us to attempt to resolve the dispute informally. We will work in good faith to resolve any issues.
Additional Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and AutoWorkx regarding your use of the platform and supersede all prior agreements and understandings.
Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver.
Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
